The EB-3 Immigration Process Post-Passing the NCLEX

 

We understand that navigating immigration process timelines may raise questions, especially when different agencies handle different parts of the process. Therefore, we think it is important to highlight the EB-3 immigration process post-passing the NCLEX and the responsibilities of each entity involved. From understanding visa requirements to meeting professional licensing standards, there are several critical steps that we hope to simplify.

I-140 Submittal

To initiate the I-140 visa petition, you must provide your Processing Officer (assigned to you early in the process with Interstaff) with documents that will be included in your petition. You will receive an email with those instructions. Interstaff, acting as your sponsor, will file the I-140 petition on your behalf. This petition requests the United States Citizenship and Immigration Service (USCIS) to grant you an immigrant visa based on employment with Interstaff.

I-140 Approval

Once submitted, the approval process can take between 5-8 months, depending on factors that are not within Interstaff’s control. Once approved, this represents a significant milestone in your immigration journey, allowing you to move on to the next phase: the National Visa Center (NVC) processing stage.

NVC Processing

After the I-140 petition is approved, it is sent to the National Visa Center (NVC) for further processing. They will assign you a case number and collect visa fee payment for you and your dependents, document collection, and more, which you will be guided through. Completing these steps is needed to make your case documentarily complete and eligible for embassy scheduling. It is important to remain truthful throughout the process so your application is not denied. 

Embassy Interview Scheduling

Once your priority date is current, the National Visa Center will schedule your embassy interview. You will need to attend an in-person interview in your home country. Interstaff will provide you with information on which documents to bring with you. The consular officer at the embassy can reject or approve your application. 

Visa Approval

Upon approval from the consular officer, you will be granted the EB-3 Immigrant visa, which allows you to enter the United States as a lawful permanent resident! Interstaff will then notify you when the time comes to provide your resignation notice to your current job and arrange travel to the U.S. It is essential to wait for Interstaff’s guidance as they coordinate your travel and arrival to the U.S.
